Terms of Service

Welcome to Vibic. These Terms of Service ("Terms") are an agreement between you and Vibic Labs LLC ("Vibic," "we," "us"), the company that operates Vibic, covering your use of the Vibic mobile app and the vibic.app website (together, the "Service").

By creating an account or signing in - whether with Google, Apple, or an email and password - you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use Vibic.

1. Who can use Vibic

You must be at least 13 years old to use Vibic. By using the Service, you confirm that you meet this requirement and that any account information you provide is accurate.

2. Your account

You're responsible for your account and for keeping your sign-in method secure - that includes the Google or Apple account you sign in with, or your Vibic password. If you believe your account has been accessed without your permission, contact us at [email protected].

3. Your content

You own it. The photos you upload and the Vibes, Moments, titles, descriptions, and tags you create remain yours. Nothing in these Terms gives us ownership of your content.

You give us permission to host it. So we can run the Service, you grant Vibic a limited, non-exclusive, worldwide, royalty-free license to store, host, reproduce, process, and display your content, and to share it with the people you've chosen through your privacy settings. Processing includes reading photo metadata (like date and location) to place your Moments on your map. This license exists solely to operate, improve, and protect the Service. It ends when you delete your content or your account, except for the limited time it takes to purge backups.

You're responsible for it. Only upload content you have the right to upload and share. That includes respecting other people's copyright and being thoughtful about photos of other people.

4. Privacy and sharing

Vibes are private by default. You control who sees each Vibe - private, your chosen people, or public. Content you set to Public is visible to other Vibic users, including in the Explore feed. How we handle your data is covered in our Privacy Policy.

5. Acceptable use

Don't use Vibic to do harm. You agree not to:

• upload content that is illegal, infringing, hateful, pornographic, exploitative of minors, or that harasses or threatens others;
• impersonate any person or misrepresent your affiliation with anyone;
• interfere with or disrupt the Service, probe or breach its security, or access it by any means other than the app and website we provide;
• scrape, harvest, or collect other users' content or information;
• reverse engineer, decompile, or copy the Service or its code.

You are solely responsible for the content you upload and for any liability that comes from it. Vibic does not pre-screen content, and responsibility for harmful or unlawful content rests with the person who uploaded it. If you see content that breaks these rules, report it to [email protected] - we will work to remove it as soon as we can.

6. Our rights

We may remove content or suspend or terminate accounts that violate these Terms or put other users at risk. Where reasonable, we'll tell you why. We may also change, add, or remove features of the Service; some features may be offered as betas that can change or end at any time.

7. Deleting your account

You can delete your account any time in the app (Settings → Delete Account). Deletion is permanent: your photos, Vibes, and associated metadata are removed from our servers, as described in the Privacy Policy. We are not able to recover a deleted account.

8. Third-party services

Signing in uses Google or Apple; maps and place lookup use Google Maps. Your use of those services is also subject to their own terms and privacy policies. We're not responsible for third-party services.

9. Disclaimers

Vibic is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We don't guarantee the Service will be uninterrupted, error-free, or that content will never be lost - please keep your own copies of photos that matter to you.

10. Limitation of liability

To the fullest extent permitted by law, Vibic and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages - including loss of data, profits, or goodwill - arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of (a) US $100 and (b) the amounts you paid Vibic in the 12 months before the claim arose.

Some jurisdictions don't allow certain limitations of liability, so parts of this section may not apply to you.

11. Indemnification

You agree to indemnify and hold Vibic harmless from claims, damages, and expenses (including reasonable legal fees) arising from content you upload or your violation of these Terms.

12. Changes to these Terms

We may update these Terms from time to time. If a change is material, we'll notify you in the app or by email before it takes effect. Continuing to use Vibic after a change takes effect means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of the jurisdiction where Vibic is established, without regard to conflict-of-law rules.
